General Terms and Conditions (GTC)

§ 1 Scope
These Terms and Conditions apply exclusively. We do not recognise any differing terms and conditions of the customer unless we have expressly agreed to their validity in writing. Our Terms and Conditions shall also apply if, despite being aware of terms and conditions of the customer that conflict with or deviate from our terms of sale, we carry out delivery to the customer without reservation.

§ 2 Contracting party, customer service
The purchase contract is concluded with Cuccioli &c. di Novati Martin (hereinafter referred to as “Puppies &c.”). Further information about us can be found in the legal notice. You can contact our customer service for questions, complaints and claims Monday to Friday from 8:00-12:00 and 13:30-17:00 on telephone number 091 225 05 02.

§ 3 Conclusion of contract
3.1. The customer submits a binding offer to conclude a purchase contract with us by confirming the order with a mouse click on the “Place order with obligation to pay” button. The customer's offer is accepted by delivery of the ordered goods.

3.2. Orders can be placed exclusively through our online shop or by telephone; orders by fax, letter, etc. are only possible in exceptional cases and in written form. To register and place an order, the customer requires a valid email address as well as a valid delivery address and billing address.

3.3. The order confirmation will be sent to the customer at the email address provided during registration or ordering.

3.4. Any further correspondence that may be necessary (payment reminders, dunning notices, etc.) between Puppies &c. and the customer will also take place by email. The customer therefore undertakes to ensure that the information provided is correct and to regularly check the email address supplied during registration/order for messages from Puppies &c. If the customer uses technical filters against spam emails, they must ensure that emails from Puppies &c. can be received.

§ 4 Credit check
Puppies &c. reserves the right to obtain creditworthiness information about the customer and may, for this purpose, forward customer data to CRIF AG, Hagenholzstrasse 81, 8050 Zurich. Puppies &c. claims an overriding interest as regulated in Art. 13 para. 2 lit. c DSG. Individual payment methods may be excluded generally or for individual customers without further explanation.

§ 5 Debt collection
If the customer fails to settle their debt within an additional deadline that has been set, Puppies &c. may claim damages and proceed in accordance with the provisions of the Swiss Code of Obligations (CO). If the debtor has to be reminded due to late payment, CHF 15.- will be charged for the first reminder and CHF 30.- for the second reminder.

Costs in the event of late payment:
After at least 2 written reminders, the case will be forwarded to a debt collection agency, which will charge a processing fee in accordance with www.fairpay.ch.

Puppies &c. has, in particular, the right to assign outstanding debts to Schweizerischer Verband Creditreform Gen, Thurgauerstrasse 36/38, 8050 Zurich. Creditreform may claim the outstanding amounts in its own name and for its own account and may charge additional processing fees in accordance with www.fairpay.ch. Furthermore, the customer is obliged to reimburse all costs incurred by Puppies &c. or third parties carrying out the debt collection as a result of the late payment. In this connection, an effective annual interest rate of up to 5% from the due date will also be charged.

§ 6 Right of withdrawal and return of goods
6.1. Consumers have the right to withdraw from the contractual declaration within 14 days of receiving the goods. The withdrawal must be communicated to Puppies &c. in writing by email to info@tierbedarf-discount.ch or by telephone on 091 225 05 02, stating the reason for the withdrawal. Exercising the right of withdrawal requires the purchase contract to be reversed, whereby the services received under the purchase contract must be returned by the consumer.

6.2 The customer must return the goods received in their original packaging (for food products, only unopened packaging and complete units are accepted) within 14 days of declaring the withdrawal to

return the goods.

The customer bears the cost of returning the goods. In the event of an incorrect delivery by Puppies &c., incorrect information in the online shop, receipt of a defective item or receipt of an incomplete product, the return costs will be borne by Puppies &c..

6.3 After receipt and inspection of the goods, the purchase price or part of the purchase price, less the shipping costs paid by Puppies &c. (parcel shipping CHF 3.80 or CHF 9.80, bulky goods CHF 12.- or truck delivery CHF 45.-) and a processing fee depending on the payment method, will, at the customer's request, either be refunded or credited in the form of a voucher. Payments by credit card, Twint, PayPal, PostFinance and PostCard will be credited directly. For the other payment methods, we ask you to provide your bank details. For goods that have not yet been paid for (purchase on invoice), the customer will receive an adjusted invoice by email or post.

6.4 Returns of incomplete or damaged items, as well as items with damaged original packaging, will not be accepted and will be returned to the customer. The return shipping costs of CHF 9.80, including a handling fee of CHF 12.-, will be charged to the customer.

6.5 In the case of unannounced returns, returns without a reason being given, or returns that were not sent to Puppies &c., Via Cantonale 5 in 6839 Sagno, the inspection of the products and reimbursement of the value of the goods may be significantly delayed. In such cases, Puppies &c. reserves the right to charge an additional handling fee of CHF 12.-.

6.6 The refund value is determined according to the following guidelines

Full refund of the value of the goods:
The item is in unopened, undamaged original packaging

Reduction depending on the condition of the goods (at least 10% or a minimum deduction of CHF 10.-):
The item or the original packaging has been opened and / or used; item labels are missing

6.7 Promotional items with a discount of 20% or more are excluded from the right of return.

§ 7 Product range and prices
The current product range and currently applicable prices can be found in our online shop. Special promotions and price adjustments at any time are reserved. The images shown on the website may differ from the actual products.

§ 8 Withdrawal from the contract

Without prejudice to further statutory provisions, Puppies &c. is entitled to withdraw from the contract without compensation if:

8.1. the customer objects to these General Terms and Conditions of Sale and Delivery.

8.2. through no fault of our own, we ourselves are not supplied properly or on time.

8.3. we must assume that the customer will not properly fulfil their contractual obligations.

8.4. the customer has ordered goods in the past and has not paid for them.

8.5. supplying the customer is no longer possible by means that are reasonable in consideration of the agreements made when the contract was concluded.

8.6. If we are unable to deliver the ordered goods because a supplier has failed to fulfil its contractual obligations, we are entitled to withdraw from the contract with the purchaser. The purchaser will be informed of this circumstance immediately. The purchaser's further statutory claims remain unaffected.

§ 9 Delivery
9.1. For orders up to a goods value of CHF 89.- (excluding bulky goods and palletised goods), shipping costs are charged for delivery within Switzerland and the Principality of Liechtenstein.

Shipping costs:
  Parcels: CHF 9.80
  Small parcels up to 250 g: CHF 3.80
  Bulky goods: CHF 12.00 (regardless of the value of the goods)
  Truck delivery: CHF 45.00 (regardless of the value of the goods)

9.2. Delivery is made to the delivery address provided by the customer via Swiss Post, DPD, Planzer parcel service, Notime (same-day delivery) or by a shipping service provider commissioned by us using a truck.

9.3. In the event of supply shortages, we are entitled to make partial deliveries and invoice them separately, provided this is reasonable for the customer and does not affect any agreed delivery period.

9.4. We deliver exclusively within Switzerland.

9.5. Delivery is generally made within 1-2 working days, except for products marked with a different delivery time. For truck deliveries, we will contact the customer regarding a delivery date. Truck deliveries are made “kerbside”.

9.6. The customer must immediately check delivered or collected products for correctness, completeness and damage. Any defects must be reported to Puppies &c. immediately upon discovery, but no later than within 2 calendar days of receipt of the shipment. In the event of defects, the customer must keep the product in the condition in which it was delivered and may not open it.

9.7. If a delivery by post / DPD is refused or in the event of a return, Puppies &c. is entitled to charge a flat-rate shipping fee of CHF 9.80 and the processing fees applicable to the payment method.

9.8 If a truck delivery is refused or an item delivered by truck is returned, Puppies &c. is entitled to charge transport costs of CHF 80.- and the processing fees applicable to the payment method.

9.9 Slow delivery: If you can wait one or two days longer for your order, choose this shipping method so that we can optimise the utilisation of our logistics and shipping operations.

§ 10 Transport insurance
You have the option of taking out transport insurance. The cost of transport insurance is 2.5% of the order value and insures your order against damage & loss during transport from us to you.

§ 11 Payment method
11.1. PostFinance Pay
With this payment method, you can pay in the online shop via e-banking using your PostFinance «yellownet» account or with the PostFinance Postcard. Processing fee: CHF 2.40

11.2 PayPal
PayPal is an internationally known escrow service that enables sellers and buyers to process payments between one another. PayPal processes the payment with you and forwards the payment to us accordingly. You can find further information about this service at www.paypal.com. Processing fee: CHF 2.40

11.3 Visa
We accept VISA. In the event of a cancellation, the full amount will, on request, be credited back to the credit card used. For online payments, the credit card will also be charged if the ordered product is not yet available for delivery. Processing fee: CHF 0.00

11.4 MasterCard
We accept MasterCard. In the event of a cancellation, the full amount will, on request, be credited back to the credit card used. For online payments, the credit card will also be charged if the ordered product is not yet available for delivery. Processing fee: CHF 0.00

11.5 Advance payment - invoice sent by email
You pay the invoice in advance. Immediately after the order, we will send you the invoice together with a payment slip by email. The goods will be dispatched after receipt of payment. Processing fee: CHF 0.00

11.6 Invoice - invoice sent by email
With this payment method, your order is supplied on invoice. After completing your order in our shop, the invoice will be sent directly to your email address. The invoice payment method is available for shopping baskets up to a value of CHF 250.00. You can also access the invoice for the respective order through your customer account. The payment period is 10 days after receipt of the goods. Puppies &c. reserves the right to obtain creditworthiness information about the customer and may, for this purpose, forward customer data to Intrum AG, Eschenstrasse 12, 8603 Schwerzenbach. Puppies &c. claims an overriding interest as regulated in Art. 13 para. 2 lit. c DSG. Individual payment methods may be excluded generally or for individual customers without further explanation. We reserve the right not to accept the payment method depending on the result of a check or if another invoice remains outstanding, and instead to change the order to advance payment. We ask for your understanding regarding this security measure. In the event of delayed payment, additional costs such as reminder fees and default interest may be incurred. Processing fee: CHF 2.40

11.7 Invoice - invoice sent by post
With this payment method, your order is supplied on invoice. The invoice will be sent to you by post after your order has been dispatched. The invoice payment method is available for shopping baskets up to a value of CHF 250.00. You can also access the invoice for the respective order through your customer account. The payment period is 10 days after receipt of the invoice. Puppies &c. reserves the right to obtain creditworthiness information about the customer and may, for this purpose, forward customer data to Intrum AG, Eschenstrasse 12, 8603 Schwerzenbach. Puppies &c. claims an overriding interest as regulated in Art. 13 para. 2 lit. c DSG. Individual payment methods may be excluded generally or for individual customers without further explanation. We reserve the right not to accept the payment method depending on the result of a check or if another invoice remains outstanding, and instead to change the order to advance payment. We ask for your understanding regarding this security measure. In the event of delayed payment, additional costs such as reminder fees and default interest may be incurred. Processing fee: CHF 3.60

11.8 Twint
You pay for the goods directly from your TWINT account. After confirming the order, you can confirm the payment using your TWINT mobile app. Processing fee: CHF 2.40

11.9 Processing fees
For certain payment methods, internal processing fees depending on the payment method are charged for processing the payment, ensuring security and checking creditworthiness. The fees are shown in the shop, order confirmation and invoice.

§ 12 Subscription orders
The pet supplies subscription (hereinafter: subscription) enables registered customers to trigger automated orders for subscription-eligible items at regular intervals without the need for repeated manual input.

Each automated order under the subscription constitutes a binding offer to Puppies &c. to conclude a purchase contract. The contract with Puppies &c. is only concluded when the ordered item is dispatched to the customer and the dispatch is confirmed to the customer by email (dispatch confirmation). If the customer does not receive a dispatch confirmation within the aforementioned period, no contract with Puppies &c. is concluded.

Before an automated order is processed, Puppies &c. sends the customer a reminder email that allows them to cancel or change the order.

12.1 Subscription discount
Puppies &c. grants a subscription discount on the regular current daily price of selected items. Information is available on the “Subscription information page”. The subscription discount received by the customer is the discount applicable to the subscription products at the time the order is processed. Certain details of the subscription and the product (including price, discount and availability) may change over time. Each subscription order is subject to the subscription and product details applicable at that time. Puppies &c. therefore reserves the right to change the subscription discount at any time.

12.2 Item availability
If an ordered item is not available on the scheduled delivery date, the order for that item will be cancelled automatically.

12.3 Term, changes and cancellation
The subscription has no minimum term. Delivery intervals can be freely selected in weeks, but must be at least two (2) and no more than sixteen (16) weeks. Changes, interruptions and cancellations of the subscription can be made at any time in the customer account. Puppies &c. may change these subscription terms at any time by publishing the amended terms on the tierbedarf-discount.ch website and informing the customer in advance in the event of material changes. By continuing to participate in the subscription, the customer agrees to these changes. If the customer does not agree with any changes to these terms, they must cancel their subscription. Puppies &c. is entitled to terminate the subscription at any time without giving reasons, in written or text form.

12.4 Payment methods
Items ordered under the subscription can only be paid for by invoice. If an initial order was placed using a different payment method, the payment method for ongoing subscription orders will automatically be changed to “Invoice”.

12.5 Orders as a guest
If the initial subscription order was placed as a guest, a customer account will automatically be created for the ongoing subscription order and the customer status will therefore be changed to “registered customer”.

§ 13 Bonus points
Each participant with a registered account can collect bonus points, which are only credited to the account after successful payment. The number of points credited depends on the purchase amount. Once payment has been made, bonus points can no longer be claimed retroactively.

In cases of force majeure and/or technical failure, Puppies &c. may temporarily suspend the crediting of bonus points. Subsequent crediting of bonus points not credited in this way is excluded.

§ 14 Prices
The stated prices include VAT and apply throughout Switzerland.

§ 15 Liability
Puppies &c. excludes, within the limits permitted by law, all liability for the products sold and delivered.

§ 16 Retention of title
The delivered goods remain the property of Puppies &c. until payment has been made in full.

§ 17 Place of jurisdiction
17.1. The place of jurisdiction is Lugano. However, we are also entitled to bring an action against the customer at the court of their place of residence if necessary.

17.2. The law of the Swiss Confederation applies. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is entirely excluded.

§ 18 Final provisions
18.1. If any provision of these General Terms and Conditions is invalid, the remainder of the contract shall remain valid.

18.2 Puppies &c. reserves the right to amend these General Terms and Conditions at any time.
